OMVI Health Terms of Use
Last updated: 19 October 2026
These terms are an agreement between you and OMVI Health Pty Ltd (ABN 17 698 486 403), Suite 12, 20 Bungan Street, Mona Vale NSW 2103, Australia ("OMVI", "we", "us"). They cover the OMVI Health app and OMVI Premium. Buying scales from our online shop at omvihealth.com is covered by the shop's own terms. Our Privacy Policy explains how we handle your information and forms part of these terms.
By creating an account, you agree to these terms. If you don't agree, please don't use the app.
1. Who can use OMVI
- You must be 18 or over to create an account.
- You can add other adults (18 or over) as family members if they agree. You're responsible for having their permission. OMVI isn't for children, and you can't add a child.
- Sharing results: when you share a scan or summary by image or link, you choose who gets it. Only share with people you trust, and send a link's passcode separately. You can turn off a link, but you can't recall a copy someone has already saved.
- Keep your sign-in details private. Tell us straight away if you think someone else has used your account.
2. What OMVI is, and what it isn't
OMVI helps you track your weight, body composition and food. It isn't a medical device, and it doesn't diagnose, treat or prevent any disease or condition.
- Body composition results (body fat, muscle, water, bone, visceral fat, metabolic rate, body age and similar) are estimates from bioelectrical impedance and published formulas. They can vary with hydration, food, exercise, skin temperature and time of day.
- Calorie and macro targets, goal dates and the 7-day outlook are general estimates based on standard formulas, not personal medical or dietetic advice.
- Food information comes from the Australian Food Composition Database, Open Food Facts and other users. It may contain errors. Check the label if accuracy matters to you, for example with allergies.
- Talk to a doctor, dietitian or other health professional before starting a diet or exercise program. Do the same if you're pregnant, have a medical condition, or are under medical care.
- Body composition scales and medical implants: don't use body composition measurement if you have a pacemaker or other implanted electronic medical device, or if you're pregnant. Weight-only mode is available for these situations.
- Reminders are a convenience. Make sure you don't rely on them for anything important to your health, such as medication.
- In an emergency, call 000 (Australia) or 111 (New Zealand).
3. AI features
OMVI Coach, the AI photo tracker, receipt scanning and eating-out suggestions use artificial intelligence (Claude, made by Anthropic).
- AI answers and photo estimates can be wrong. They're general information and suggestions, not medical, dietetic, or other professional advice.
- Check estimates before relying on them. Use OMVI Nutrition or the pack label when you can.
- Eating out: suggestions for restaurants and cafés are estimates unless the app says they come from the chain's official nutrition guide. Menus, recipes and serve sizes change, so check the place's own nutrition information if you need exact figures, and always check allergens with the place itself.
- Talking to your coach: what you say is turned into text on your phone and treated like a typed message. Check dictated text before you send it.
- Using the AI features: don't use them to seek emergency help or diagnosis, or to produce anything unlawful or harmful.
- What's shared: the Privacy Policy explains what's shared with the AI provider. The app asks for your permission before your first use.
4. OMVI Premium
- Price: OMVI Premium is a monthly subscription, currently A$9.99 a month in Australia. Prices in other countries are shown in the App Store.
- Billing: payment is charged to your Apple Account when you confirm the purchase.
- Renewal: the subscription renews automatically each month at the same price unless you cancel at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the period ends.
- Cancelling: you can manage or cancel your subscription at any time in your Apple Account settings, or in the app under Me › OMVI Premium › Manage subscription. Cancelling stops the next renewal; you keep Premium until the end of the period you've paid for.
- Free trial: if we offer one, any unused part of it ends when you buy a subscription.
- Refunds: these are handled by Apple under Apple's terms, at reportaproblem.apple.com. Nothing in these terms limits your rights under the Australian Consumer Law or the Consumer Guarantees Act (section 9).
- Price changes: if the price changes, Apple will tell you in advance, and where the law requires, ask you to agree.
- Fair use: Premium includes generous daily limits on AI use to keep the service fast and fair for everyone. If you reach a limit, it resets the next day.
- Free features: everything except OMVI Coach and photo scans beyond 2 a day is free. Your scales work fully without Premium.
- Deleting your account doesn't cancel your Apple subscription. Cancel it first.
5. Your content
- What you own: you keep ownership of what you put into OMVI, such as your measurements, food log, recipes, photos and messages.
- Our permission to use it: you give us permission to store and use it only to provide the app to you, as set out in the Privacy Policy.
- Foods you add: if you add a food to the shared database, you give us and other users permission to use that food's name and nutrition information. Only add accurate information you're allowed to share.
- Downloading and deleting: you can download your data or delete your account at any time.
6. Using OMVI fairly
Please don't:
- break the law, or use OMVI to harm, harass or mislead anyone;
- add someone else's information without their permission;
- try to access other people's accounts or data, or get around the app's security, limits or subscription checks;
- copy, reverse engineer or resell the app, except where the law allows;
- upload anything harmful, such as malware, or flood the service with automated requests.
We may suspend or close an account that seriously or repeatedly breaks these terms. Unless there's a safety or legal reason not to, we'll tell you first and give you a chance to download your data.
7. Our app and other content
- Ownership of the app: the app, its design and the OMVI name and logo belong to OMVI or our licensors. We give you a personal, non-transferable licence to use the app on Apple devices you own or control, under these terms and Apple's App Store rules.
- Open Food Facts: some food data comes from Open Food Facts, licensed under the Open Database License (opendatacommons.org/licenses/odbl). Product images are licensed under Creative Commons Attribution-ShareAlike.
- Australian Food Composition Database: some food data comes from it, © Food Standards Australia New Zealand.
- Your scales: the scale software is used under licence from the scales' manufacturer.
8. Changes and availability
- Changes to the app: we're always improving OMVI and may change or remove features. If we remove a paid feature you've subscribed to, we'll tell you first, and you can cancel.
- Availability: we work hard to keep OMVI available but can't promise it will always be uninterrupted or error-free. Your scale measurements still display on the scale itself if the app is unavailable.
- Changes to these terms: we may update these terms, for example when the law or the app changes. We'll tell you in the app at least 14 days before an important change takes effect and ask you to agree to the new terms. If you don't agree, you can delete your account; if you subscribe to OMVI Premium, you can cancel it and keep it until the end of the period you've paid for.
9. Your consumer rights
Australia. Our goods and services come with guarantees that can't be excluded under the Australian Consumer Law. For major failures with a service, you're entitled to:
- cancel your service contract with us; and
- a refund for the unused portion, or compensation for its reduced value.
You're also entitled to be compensated for any other reasonably foreseeable loss or damage. If a failure doesn't amount to a major failure, you're entitled to have problems with the service rectified in a reasonable time. If this isn't done, you're entitled to cancel your contract and obtain a refund for the unused portion of the contract.
New Zealand. If you're in New Zealand, you have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 that these terms don't limit.
Nothing in these terms excludes, restricts or changes any right or remedy you have under these laws.
10. Limits on our responsibility
These limits apply only as far as the law allows, and they don't affect your rights in section 9.
- Health decisions: we're not responsible for decisions you make based on estimates, targets or AI suggestions in the app without checking with a health professional.
- Outside our control: we're not responsible for loss caused by things outside our reasonable control, such as outages at Apple, internet failures or your phone's settings.
- Our liability cap: where the law lets us limit our liability for a service failure, our liability is limited to supplying the service again, or paying the cost of having it supplied again. For any other loss, it's limited to the amount you paid us for OMVI Premium in the 12 months before the claim.
Our scales. Your OMVI scales have their own warranty, which comes with the scale and is separate from these terms.
11. Apple
These terms are between you and OMVI, not Apple.
- Responsibility for the app: OMVI, not Apple, is responsible for the app and its content.
- Maintenance and support: Apple has no obligation to provide any maintenance or support for the app.
- Warranty: if the app fails to meet any applicable warranty, you can notify Apple and Apple will refund the purchase price (if any). To the extent the law allows, Apple has no other warranty obligation.
- Claims: Apple isn't responsible for claims relating to the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection or privacy claims, or intellectual property claims. Any such claims are OMVI's responsibility.
- Your promises: you confirm that you're not in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you're not on any US Government list of prohibited or restricted parties.
- Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
- Apple's terms: you must also follow any third-party terms that apply when you use the app, such as your mobile carrier's.
12. Ending this agreement
- Leaving: you can stop using OMVI and delete your account at any time (Me › Privacy and legal › Delete my account).
- What happens when you delete your account: we delete your information as described in the Privacy Policy.
- What continues afterwards: sections 9, 10, 13 and 14 continue to apply.
13. Law and disputes
- Governing law: if you live in New Zealand, New Zealand law applies and you can bring proceedings in New Zealand. Otherwise, these terms are governed by the law of New South Wales, Australia.
- Complaints: if you have a problem, please contact us first at app@omvihealth.com. We'll try to resolve it within 30 days.
14. General
- Whole agreement: these terms, the Privacy Policy and Apple's terms for the App Store are the whole agreement between you and OMVI about the app.
- If part doesn't apply: if a court decides part of these terms can't be enforced, the rest still applies.
- No waiver: if we don't enforce a right straight away, we can still enforce it later.
- Transfer: we may transfer this agreement to a business that takes over OMVI. If we do, we'll tell you first, your rights won't be reduced, and your information stays protected under the Privacy Policy. You can't transfer your account to someone else.
